        This privacy policy describes how and why Audionamix (“Audionamix”, “we” or “us”) processes your personal data when you access or use any part of the website www.audionamix.com (the “website“), shop online, install, activate or use our software, communicate or interact with us in any other way. This privacy policy is meant to help you understand what data we may collect, under which circumstances we collect it, why we collect it and what we do with it. You will also find information about your rights, and how you can control the processing of your personal data.

        The collection of personal data is carried out with the consent of the website user, in compliance with the EU Regulation of the 27th of April 2016 and Law No. 78-17 of the 6th of January 1978.

        You are required to communicate only personal data to AUDIONAMIX that strictly concerns you. You are prohibited from disclosing the personal data of another person and/or personal data that does not concern you.

        This data protection policy may be updated in accordance with legal provisions.

        Personal data collected is as follows: (i) the information provided by you when completing the forms relating to the creation of your account and/or relating to your orders and/or relating to your identification, or by communicating with AUDIONAMIX (by any means of communication or online communication, or by replying to questionnaires or satisfaction surveys) (ii) concerning in particular your name, as well as your contact details such as your postal address, e-mail address, telephone numbers, electronic signature, national identity card data (iii) as well as in particular information relating to the contractual and commercial relationship between your and AUDIONAMIX (in particular details of products, services and/or Documents ordered by you) (iv) your banking information (bank details, card numbers) and transactional numbers (v) as well as data collected through cookies and similar technologies used on the website (including IP addresses) and in electronic messages that allow you to be identified, remembered and, where applicable, presented with content that may be of interest to you.         You are required to communicate only personal data to AUDIONAMIX that strictly concerns you. You are prohibited from disclosing the personal data of another person and/or personal data that does not concern you.

        The processing operations carried out by AUDIONAMIX in the management and use of its website fulfill a specific, legitimate and explicit purpose. In particular, you are informed that the information you provide through the forms on the website is necessary to respond to your request and is intended for AUDIONAMIX, the controller. The data is processed mainly for the following purposes:

        • the identification of users during orders placed on the website;
        • the identification of users when using the website services;
        • the realization and/or the delivery by AUDIONAMIX of the services and orders made on the website;
        • invoicing;
        • subscription to the Audionamix Newsletter.

      5. Legal basis of the processing operation

        The legal basis for the processing operation is as follows: (i) the processing is necessary for the execution of the contractual relationship that you wish to establish with AUDIONAMIX. This contractual relation includes but is not limited to; ordering and/or using services and/or Documents. The aforementioned personal data is necessary for the performance of the ordered services by you (ii) the processing is also necessary to protect AUDIONAMIX's legitimate interests by allowing it to keep proof of transactions with you and/or, where applicable, the proceeding of recovery (iii) the processing is based on the consent of your wishing to order and/or use Documents and/or services via the website (iv) the processing being administered in accordance with the provisions of Law n°78-17 of the 6th of January 1978 and EU Regulation 2016/679 of the 27th of April 2016 (GDPR) and the other legal provisions in force (hereinafter the "Regulations in force").

      6. Recipients of personal data

        The recipients of the personal data are: the AUDIONAMIX personnel in charge of the production and/or administration of the services and/or Documents ordered and/or used by you, the production and/or delivery by AUDIONAMIX of the products, services, documents and/or services ordered and/or used by you and, where applicable, AUDIONAMIX's subcontractors participating in the performance of these missions and being required to intervene on the processing operations (only when necessary), and the IT service providers involved in the strict performance of its missions, it being specified that in such a case this is done in compliance with the Regulations in force applicable to subcontractors.

        Thus AUDIONAMIX only communicates personal data to authorised and predetermined recipients.

      7. Storage period for personal data

        The storage period for personal data is as follows: since personal data is necessary for the performance, administration and/or delivery of services and/or orders made via the website, your personal data is stored (i) as long as you are likely to be able to place orders, i.e. as long as you have not indicated your intention to no longer be an AUDIONAMIX customer or to no longer have your personal data stored, and this via a request made by you to the following address: nicolas.cattaneo@audionamix.com (in accordance with the provisions below) (ii) within the limit of 36 (thirty-six) months from the last order for services and/or Documents placed by you via the website, the date on which personal data is no longer stored.

        Personal data is stored for the time corresponding to the purpose of collection and in compliance with the legislation in force.

        AUDIONAMIX does everything possible and undertakes to do everything within its power to ensure the protection of personal data (both physical and logistical).

      10. Your rights that may be exercised with the controller (as identified above)

        The purpose of this agreement is also to inform you of the existence of your right to ask the controller (as identified above):
            - access to your personal data and any available information as to its source;
            - the correction or deletion of these;
            - a limitation of the processing of your personal data
            - your opposition to the processing of your personal data;
            - your opposition at any time to the processing of your personal data for prospecting purposes, including profiling;
            - the portability of the personal data under the conditions of the Regulation in place, which provides in particular that data subjects are entitled to receive the personal data relating to them which they have provided to a controller, in a structured format, commonly used and machine-readable, and are entitled to transmit such data to another controller without the controller to whom the personal data have been disclosed impeding it, where: (i) the processing is based on consent pursuant to the Regulations in force, or on a contract pursuant to the Regulations in force and (ii) where the processing is carried out by automated means, it being specified that when the data subject exercises their right to the portability of their personal data, they have the right to obtain that their personal data be transmitted directly from one controller to another, where this is technically possible.

        Where necessary, it is stipulated that the exercise by you of your right to erase your personal data and/or the exercise of your right to object to the processing of your personal data and/or the exercise of your right to a limitation of the processing of your personal data and/or your right to withdraw your consent at any time to the processing of your personal data (in accordance with the aforementioned provisions) shall not make possible the delivery of the services and/or Documents ordered and/or used by you and, more generally, not to make it possible to carry out the services ordered and/or used, so that, in such cases (i) as from the exercise by you of said rights, you will no longer be able to access the services and services delivered by AUDIONAMIX via the website (ii) if these rights are exercised at the time of ordering services or Documents, then the aforesaid order may not be placed by you (iii) and, if you hold a subscription contract, the account of the latter recipient of your personal data will be deleted.

        In accordance with Articles 15 to 18 and 21 of Regulation (EU) 2016/679 of the European Parliament and of the Council of the 27th of April 2016 (GDPR), you thus have a right of access to your personal data, a right of rectification, erasure, as well as a right to limit the processing of such data, portability and to define the fate of your data after your death in relation to all data concerning you when using the website https://audionamix.com/ and a right of objection.

      12. Information on the contractual nature of the provision of personal data

        With regard to the provision of information to you on whether the requirement to provide personal data is of a regulatory or contractual nature or whether it is a condition for the conclusion of a contract and whether the data subject is required to provide the personal data, as well as on the possible consequences of not providing such data, you shall be informed of the following information: (i) the request for the provision of personal data is of a contractual nature (as part of the relationship that you wishes to establish with AUDIONAMIX by placing an order for services or Documents and/or by using such services) (ii) the provision of such data, in so far as it is necessary for the performance of the ordered services conditions the conclusion of this contractual relationship (iii) as such, you are required to communicate your personal data if you wish to order and/or use services and/or Documents from AUDIONAMIX and via the website (iv) the failure to provide such personal data does not allow you to order services and/or Documents from AUDIONAMIX.

        It is stated that automated decision-making within the meaning of the Regulations in force is not carried out using the personal data collected.

      14. Possible further processing of personal data

        In the event that further processing of personal data is carried out for purposes other than those for which the personal data were collected and as identified above, the controller (identified above) shall first provide the data subject with information about that other purpose and any other relevant legal information required.

        MINIMUM AGE OF USERS

        As the collection of personal data can only concern persons aged at least of 15 years, and as personal data is, as indicated above, necessary for the performance and administration of the services or Documents ordered or requested via the website, persons under 15 (fifteen) years of age may only give their consent to the collection of their personal data (and consequently access the services deployed via the website) if they are authorised by the holder of parental responsibility concerning them, so that, by requesting the accessible services via the website and/or by communicating personal data to AUDIONAMIX, Users declare and guarantee to AUDIONAMIX that they are (i) either at least 15 years old (ii) or that they are authorised by the holder of parental responsibility concerning them.
